Apartment Notice Apartment opinion? My husband and I found a duplex to rent nice, although we hope to leave the apartment by June 30, well thats not 30 days from the first of the month. But the thing is ..... we went to our apartment two years and a month. t Hasn landlord made us sign a new contract ..... Since we have no right to lease now ... is in any way if we're less than July 1 that it can make us pay that month's rent (for July), since we basically have a month to month tenate? I'll give you his opinion, but not the full 30 days. I do not care about getting the deposit, I do not want to pay for the month of July! Thank you Melissa In most states all requirements of notice is a full month, 30 days, as of the 1st to the 30th is a full month. Without a lease the landlord has nothing to show to the court to make you pay the monthly rent. In a lease, it will indicate how long a notice that you have to do before leaving, but without that they cannot get paid. Some places require advance notice of 30 days from the first day of the month, others just need 30 days. For ex. notice today would end your obligation on July 9. You need to look at your contract, just because your lease has expired does not mean that you are not obliged to fulfill the terms of lease. Talk to your landlord, sometimes they can rent the apartment to someone else, you will not have to pay after they moved in. Good luck! Posted on August 7, 2010.
