Farm LeaseThe contents of a lease

No matter how you decide to go with your lease, you'll need some tools to help you achieve the best possible lease. Personally, I'm a fan of checklists, it only makes sense to use one to help you understand what you should have the lease eventually decide to use

The list below is likely very close to that of lawyer for the use of reference if it was drafting a lease for a client. This list will be extremely consistent, wherever you live.

We'll go through the list and I'll give a brief explanation of each item I list. Keep in mind that each item may not be necessary, but must be considered. A good lawyer might help you decide.

Party-people involved in the lease. Each person or entity is party to a lease. You could have two or more parties to a lease.

-Names of all parties or entities on the lease must be named.

Address-party, if different from the leased address.

Other identification as required.

Subject to lease

Address or legal description of the property, the address of the property leased.

Tenant effect, whether residential, commercial, agricultural, etc

Restrictions on the use of the real limits to the use and occupation.

Duration of the agreement or a lease-option contract duration including start date and end.

Provisions to be included in the lease after

Parties generally refers to the names of minors / pets.

Subject Day fixed term when the rent is due and when considered late.

Rental payments amount of payment and security deposit.

Access to property, right to enter property in case of emergencies, repairs, or comment on the report in a timely manner.

Designation of the party responsible for repair, which is responsible for repairs and what action if repairs not made in a timely manner.

Identification of belonging - that goes with or is related to leased premises (machines, equipment, etc.)

Responsibility for paying utilities, sewers, water, waste, etc..

Liability for taxes and contributions, in some leases, tenants are responsible for these items.

Renewal option provisions, conditions and deadlines for the renewal of the lease of the premises.

Purchase option provisions, conditions and deadlines for the purchase of premises.

The transferability of the lease if you can sublet or not.

Execution date when the lease was signed by the parties.

Signatures of the signatures of the parties.

This completes the checklist that you can use the structure of your lease. It is very likely and in fact quite common that you could include other provisions in your lease other than those listed.

For example, many people write their rules and regulations in the lease itself. These regulations cover such things as noise, lock-outs, pets, and parking. Other owners simply hand the rules after the fact, but could write the changes to their standard lease that they deem necessary.

Whatever you decide to include in your lease, make sure it can do its "work where appropriate, in a court of law.
