Lease Guaranty I signed a lease for an apartment security on behalf of my son. It expired on 2/28/07.? My son has signed another contact after that I do not sign as guarantor and was finally expelled in June 2009. The apartments has sent me a bill saying that I am obliged to pay his bill guarantees that the contact is permanent and does not end. I do not think rolling contacts such as these are legal in Texas. I refuse to pay for his balance. Am I legally obligated to pay for his bill as a guarantor for the contact, which expired in 2007? An agreement on joint signatory to a separate contract of lease and are not related and do not expire simultaneously. You are not removed as his co-signer until something is signed, you remove. It is effective as long as he remained there, or not renew the lease. If your son has signed a new contract after the expiry of the other that you should not be held. If your son has never signed a new contract and just spend a month to month that you remain responsible as you would still be on the lease. I would go talk to a lawyer and they should establish a hearing date to try to get the balance you all and I would recommend going to that and talk to the judge about it. Also try to find copies of all agreements of 2007, if you can. Usually when it will expire by LEA month. If no new contract was signed, I think you could be liable. Your son has signed a new contract, but for a different time, your contract can always cover the contracted period before 2/28/07. If the landlord's claim form did something that took place during the time your contract was in fact maybe you could be liable for it. It probably depends on the details of the guarantee that you signed. Yes, you need legal advice. If I understand it, is strictly secular, that contracts are not automatically renewed. I also know that there is nothing in the contract may be written, but may not be legal. I would ask a lawyer. I'll try a bluff before I paid and read the contract and see about renewing automatically. All contracts must have a start date and end. . . New I suppose. . . I send them a letter that the contract has expired and you're not responsible. In case of problems with your credit this incident, you consider legal action. . . Blah blah blah. . . Keep copies of all your letters and send them return receipt requested and start this file and keep it forever. I would also consider seriously beat my son. . . Only a lawyer in TX can give you the advice you seek, first, you can have a positive obligation to revoke the guarantee or may have found the signature of the new contract terminated your coverage is possible at this stage it sounds like your son is not collectable and they come after you with a signed paper, as such you must be proactive before turning to the collections and Ding your credit Ask to see the contract bond on your site.
