Termination Of Tenancy FormPlease help me! question of expulsion?

Okay, I have lived in this house under an agreement from month to month, which is signed by me and me alone. I had two women move in (it's a house 3BR) January 15 and they have caused the inferno! They hit, thrown, and used my personal affairs (including drinking a bottle $ 50 non-replaceable wine), a dog in the house when I did adament that owners do not allow pets, and I was tired! I want to deport them, but I know they pay their rent directly to the owners, not me, which I realize puts a damper on what rights do I have to evict them. So, what can I do? And where can I find a 30-day notice of termination of lease form? Thank you very much! Enjoy it!

If they are to pay the rent directly to the landlord, the landlord was notified when they moved in. In this case, a new lease should have been established with three of your names on it and the three signatures. Otherwise, you take full responsibility for any damage to the house. Not a good idea.

But since yours is the only signature, and you take full responsibility, you are within your rights to ask them to leave the property. They have no legal right to be there, if they do not have a lease.

Looks like you're subletting and not the owner. I do not know if you have the right to expel these females. The owner may have to file the documents.

You can contact the local courthouse for more information and drop kick "on the tenant" shapes. The courthouse will send a police authority or others to serve the papers.

First - remember where you are asked this question ... do not think our responses (including mine), but do research and check things for yourself. The problem is legal and could cause you great harm.

My best answer is to understand what the law says California - http://www.dca.ca.gov/legal/landlordbook ... If you were in Oregon, I could give you a better answer - but I would like still tell you to look at the law.

I do not see where this is a problem. Here are the facts,
1) You signed a lease in the lease is a binding contract name.The. You say that you must pay a certain amount of rent on a certain day every month.
2) You have received a copy of the rules and regulations. One of these rules has been violated is the state dog, which you said not to do and why.
3) They have no right to receive, use or throw away everything that belongs to you. It's trespassing.
4) Now! Since everything is in your name, why they pay the owner directly to rent and not pay you? Did he give them permission to live with you and you say OK?
5) Legally it does not matter if you have your story straight. You have all legal rights to throw their belongings out of the apartment. Tell your landlord that you will pay for the lock change and explain what you just tell us.

Ultimately, it is not on the lease and knowingly violated the lease, they can not stay there. There is no notice of eviction if they do not have a lease. They are squatters, at best.
